How renting works in Incheon
Choose jeonse or wolse, then protect the deposit — in that order and with more attention to the second than the first. JEONSE (전세) is a lump sum of typically 50-80% of the property's value with no monthly rent, returned at the end; WOLSE (월세) is a smaller deposit plus rent, and is what almost every newcomer should take. The protections are the same either way and they are sequential: read the property register before any money moves, take possession and file the move-in report on the same day, get the fixed-date stamp, file the lease report, and consider HUG deposit-return insurance. The Housing Lease Protection Act gives you a two-year minimum term, one renewal you may demand, and a 5% cap on the increase at that renewal.

Read the property register, then read it again on payment day
Pull the 등기부등본 for the exact unit — anyone can get it online for a small fee without the landlord's permission. It shows the registered owner and everything secured against the property. If existing mortgages plus your deposit approach or exceed what the unit is worth, that is a 깡통전세 and you walk away. Confirm the person signing is the registered owner or holds a notarised power of attorney. Then pull it again on the morning you hand over the balance, because the picture can change between the viewing and the signing. In Incheon this is not a theoretical precaution: the Michuhol-gu case turned on a landlord group building a portfolio of over-encumbered units and letting them all fail at once.

Understand the one-day gap, because it is the gap fraud lives in
Your opposing power (대항력) under the Housing Lease Protection Act arises from actually occupying the home and registering your residence — but it takes effect only from midnight at the start of the following day. A mortgage registered on the same day you pay therefore ranks ahead of you. This is the specific mechanism behind a large share of Korea's deposit-fraud losses. The standard defences are a contract clause forbidding the landlord from creating any new encumbrance until your registration takes effect, and re-checking the register the next morning while you still have remedies.

File the move-in report and the fixed-date stamp on the day you take the keys
The move-in report (전입신고) at your district office or online, plus the fixed-date stamp (확정일자) on the lease, together create the priority right of repayment (우선변제권) — the right to be paid from auction proceeds ahead of anyone ranking after you. Separately, leases with a deposit above ₩60 million or rent above ₩300,000 a month must be reported under the lease reporting system within thirty days, and penalties have been enforced on contracts signed from 1 June 2025. The Ministry of Land cut the scale at the same time: a simple late filing now runs ₩20,000–300,000, and the ₩1 million ceiling remains only for a false declaration. Filing that lease report with the contract attached is treated as granting the fixed date, so one visit can do both — but a fixed date alone does not discharge the reporting duty.

The law ring-fences a slice of smaller deposits ahead of every other creditor, on regional ceilings. Most of Incheon sits inside the Seoul-area overcrowding-restriction zone — a deposit up to ₩145 million qualifies with ₩48 million protected first in line. But Schedule 1 to the Enforcement Decree of the Metropolitan Area Readjustment Planning Act carves the Incheon Free Economic Zone out of that zone, so Songdo, Cheongna and Yeongjong fall into the ordinary metropolitan-city band instead: ₩85 million qualifying, ₩28 million protected. The same schedule also excludes Ganghwa-gun, Ongjin-gun, the Namdong national industrial complex and eight dong of Seo-gu around Geomdan. Two flats a few kilometres apart in the same city are therefore treated differently, and the whole protection is capped at half the property's value either way. The figures are set by enforcement decree and revised, so confirm the current numbers and your address's classification at the district office before deciding how much deposit to hand over.

Price HUG guarantee insurance, and read a refusal as a warning
HUG's deposit-return guarantee pays out if the landlord cannot return your money. Underwriting tightened sharply after the fraud wave: for non-apartment properties — villas, multi-family houses, many officetels — the property is valued at 140% of its official assessed price and only 90% of that can be covered, so a deposit above roughly 126% of the assessed price cannot be insured at all. When a landlord says a villa 'cannot be guaranteed', that is usually not paperwork. It means the deposit exceeds what the unit is officially worth, which is precisely the situation you are trying to avoid.

Know your renewal rights and what to do if the deposit is not returned
A residential lease carries a two-year minimum you can insist on even if the paper says less, and you may demand one renewal for a further two years, requested between six and two months before expiry, with the increase capped at 5%. The landlord can refuse only on limited grounds, chiefly that they or an immediate family member will genuinely live there. If the term ends and your deposit is not returned, apply to the court for a lease registration order (임차권등기명령) before you move out — it preserves your opposing power and priority right after you leave, and since the 2023 amendment it takes effect on issue rather than waiting to be served on a landlord who is avoiding you. Certified victims of deposit fraud can also access the special act's support measures through the local government.
Upfront cost
Wolse: the refundable deposit (₩5–30 million is normal for an Incheon one-bed, and a larger deposit buys a lower monthly rent — the two are explicitly interchangeable), the first month's rent, and the agent's commission. Jeonse: 50-80% of the property's value, usually 10% at signing and the balance on move-in. On top of both: the monthly building maintenance fee (관리비), quoted separately and commonly ₩100,000–350,000 in Songdo's tall towers, plus utilities. Agent commission is capped by city ordinance on a sliding scale of transaction value, and landlord and tenant each pay their own agent.
Where to search
Insider tips
- Take wolse rather than jeonse until you genuinely understand the system. The downside of getting jeonse wrong is total rather than partial, and Incheon has the case law to prove it.
- The deposit and the monthly rent trade off explicitly. Landlords will quote a conversion rate — more deposit, less rent — so negotiate the split that matches your cash position instead of accepting the advertised pair.
- Check which side of the Free Economic Zone boundary your address falls on. It changes your small-deposit protection bracket, and neither the agent nor the landlord is likely to raise it.
- Ask what the maintenance fee covers before signing. Since 2023 agents advertising units with a fee over ₩100,000 have had to itemise it, so ask for the breakdown in writing — Songdo's tower fees are high and the heating share can surprise you.
- If you are moving for a school, get the school's written confirmation that your child is eligible before you sign a lease. Korean nationals need three years of residence abroad to enrol at a foreign school and the places are capped at a proportion of the intake.
- Test the commute on a weekday morning before committing. Songdo to central Seoul, Cheongna to Songdo and anything crossing to Yeongjong all take considerably longer than a map suggests, and there is no fast link between the new districts.
Avoid these
- Paying a deposit without pulling the property register first, and without re-checking it on the day the balance changes hands.
- Not realising the protection from your move-in report only starts at midnight the following day, leaving a window a dishonest landlord can use.
- Getting the fixed-date stamp but skipping the separate lease report, which has carried a late-filing fine of up to ₩300,000 on contracts signed from June 2025.
- Assuming one deposit-protection bracket applies across Incheon when the Free Economic Zone is carved out of the Seoul-area zone.
- Reading a refusal of HUG guarantee cover as red tape rather than as evidence the deposit exceeds the property's assessed value.
- Moving out at the end of the term without the deposit returned, instead of first obtaining a lease registration order.
