Enter on a travel visa, with a sponsor
Apply through the DGM's portal at evisa.gouv.cd or a Congolese mission. Travel visas run from eight days to six months and must be used within three months of issue. A Congolese sponsor — normally your employer — is a substantive requirement. For Lubumbashi arrivals the practical entry point is often the direct Johannesburg or Addis flight rather than Kinshasa, which avoids a domestic connection and a second set of formalities.

Your employer files the work card with the provincial Division de l'Emploi
This is the Haut-Katanga difference. Applicants in Kinshasa lodge with the CNEE technical secretariat; applicants in the provinces lodge with the Division provinciale de l'Emploi et du Travail, which then feeds the same commission. The rest of the chain is identical — commission, DGRAD note de perception, payment, biometric capture, card printing, delivery through the Ministry.

File the establishment visa at the DGM's provincial direction
The categories are set by Ordonnance 87-281: work (running with the work card, itself two years maximum), ordinary (three years, renewable, for people on their own means), special (five years, for investors approved under the investment code), studies (one year) and missionary (five years). Note the carve-out that matters here: mining investments run under the Code minier rather than the Code des investissements, so the 'special' investor category is not the route most people in this city are on.

Know where the mining-zone ban does and does not apply
Loi 86-007 du 27 décembre 1986 prohibits foreigners from staying or circulating in a schedule of mining zones, with six months to two years' imprisonment for breach and blacklisting as an undesirable after expulsion. Article 1 lists the whole of both Kasaïs, territories in North Kivu, South Kivu and Maniema, parts of Bas-Congo, all of Ituri and Haut-Uélé, and territories in Bandundu. Shaba/Katanga is absent. Exemptions and circulation permits are granted through an interdepartmental commission chaired by territorial administration, set up by arrêté 86/0663.

Renew early, and never let a file lapse instead
The work cycle is tied to a card of at most two years; the ordinary category runs three years. Ordonnance-loi 83-033 art. 22 makes irregular stay a criminal matter with servitude pénale and a fine, and art. 15 allows expulsion. In a province with as much movement across the Zambian border as this one, a lapsed status is discovered at a frontier rather than at a desk.

Things most newcomers don’t know
Katanga is not a designated mining zone, and the Kasaïs are.
It is counter-intuitive — the copper belt is the mining province — but Loi 86-007's Article 1 schedule is about diamond and artisanal-mineral areas and about the east. Getting this right in both directions matters: it means you can live in Lubumbashi normally, and it means a trip to Mbuji-Mayi or Tshikapa is a legal question before it is a logistics one.

The provincial Division de l'Emploi is your employer's counterparty, not the CNEE in Kinshasa.
The Ministry's own procedure routes provincial applicants through the Division provinciale de l'Emploi et du Travail. Employers who have only ever hired in Kinshasa sometimes send the file to the wrong place and lose weeks, which is the kind of delay that is invisible to you until your travel visa is running out.

Your employer's IERE bill is probably half what a Kinshasa employer pays.
The exceptional tax on expatriate remuneration is 25% of gross, borne by the employer — except that mining companies pay 12.5% during their first ten years of activity. In a province where most foreign hires are mining or mining-adjacent, that halving materially changes what a company will pay for an expatriate, and it is a fact worth having in a salary negotiation.

There is still no digital-nomad, freelance or retirement visa anywhere in Congolese law.
The categories are the five in the 1987 ordinance plus what the DGM applies in practice. Anyone selling you a 'DRC remote work visa' is selling something that does not exist. If you are self-supporting, the honest answer is the ordinary establishment visa, three years, renewable, with a means test that has no published threshold.

Common mistakes to avoid
- Arriving expecting to land on an establishment visa — six months of prior lawful residence come first
- Letting an employer send a Haut-Katanga work-card file to the Kinshasa secretariat
- Travelling to the Kasaïs or the north-east without checking Loi 86-007 first
- Paying anyone anything without a DGRAD note de perception
- Assuming a mining investment gets the investor establishment visa — mining runs under the Code minier, a different track
- Photographing mine sites, government buildings or the border post, which is a reliable way to be detained
